Terms and conditions of sale for the website www.lefildelame-paris.com (hereinafter referred to as the ‘Website’)

Article 1: Scope of application
These general terms and conditions of sale (GTC) apply exclusively to all sales of products concluded between Le Fil de l’Âme and non-professional consumers via the website www.lefildelame-paris.com, hereinafter referred to as the ‘Customer(s)’. These GTC do not apply to professionals purchasing within the scope of their professional activities, wholesalers and distributors.
Le Fil de l’Âme is able to deliver Products throughout the European Union and the United States.
‘Products’ refers to all products sold via the Website www.lefildelame-paris.com
‘Le Fil de l’Âme Address’ refers to the following postal address for ‘Le Fil de l’Âme’: Safrane Cortambert / Le Fil de l’Âme – 3 rue du Bois de Boulogne – 75016 – Paris
Placing an order implies the Customer’s full and unreserved acceptance of these GTC, to the exclusion of all other documents such as catalogues, brochures, etc. issued by Le Fil de l’Âme, which are for information purposes only. Any contrary condition put forward by the Customer shall therefore, in the absence of express acceptance by Le Fil de l’Âme, be unenforceable against Le Fil de l’Âme, regardless of when it may have been brought to its attention. The fact that Le Fil de l’Âme does not invoke any of the provisions of these GTC at a given time shall not be interpreted as a waiver of its right to invoke any of said conditions at a later date. The Customer may consult these GTC freely and at any time by clicking on the ‘GTC’ link in the Site’s navigation bar. Le Fil de l’Âme reserves the right to modify these GTC at any time.
Article 2: Photos
The essential characteristics of Le Fil de l’Âme Products are described alongside one or more photographs which, despite all the precautions taken by Le Fil de l’Âme, may differ slightly from the item offered for sale due to the distance from which the photos were taken, the processing of the photographs and the method of transmission and display of data on the screen. Le Fil de l’Âme cannot be held responsible for this.
Article 3: Ordering
3.1. The Customer places their order according to the process in force on the Website, namely:
– You can choose your Products without logging in.
– To start shopping: choose a Product and click on the product description to view its characteristics (size, colour, variations, price, etc.).
– Click on ‘Add to basket’ to order the Product.
– The Product is automatically added to the basket, which can be viewed by clicking on the icon at the top right of the screen.
– The desired quantity of each product in the basket can be changed by clicking on the ‘+’ or ‘-’ buttons.
-Step 1 ‘SUMMARY’: in the basket, you can choose to change quantities, cancel Products, continue shopping, add a promotional code and confirm. If you choose to confirm: click on ‘order’.
-Step 2 ‘REGISTER’: the ‘AUTHENTICATION’ page will open if you are not yet logged in and will ask you for your email address and password if you already have an account, or to create an account.
-Step 3 ‘ADDRESS’: choose a delivery address and a billing address.
-Step 4: ‘DELIVERY’: Choose your delivery method. The delivery time and cost are indicated next to each of the available delivery methods. However, delivery times are indicative and Le Fil de l’Âme is not responsible for any delays in delivery by a service provider. For more details, please refer to Article 8. You must read the ‘terms and conditions of sale’ and then accept them (by ticking the box) in order to proceed to payment. Then click on ‘Order’.
-Step 5: ‘PAYMENT’: choose your payment method: PayPal (with a PayPal account, or with a credit card without a PayPal account) or credit card.-Your order is only effective once payment has been made. The order is summarised in a ‘BASKET’, which can be viewed at any time and contains all the items in the order and indicates the total price including delivery costs depending on the delivery method chosen.
When creating an account, the Customer is required to fill in all the mandatory fields: title, first name, surname, address, access code, floor, building number and other necessary information, as well as a telephone number where the Customer can be reached during the day. The Customer is required to provide accurate and truthful information.
The Customer may cancel their order, even before delivery, under the conditions set out in Article 10 ‘Right of withdrawal’.
Article 4: Order Confirmation
4.1. Once your order has been finalised, you will receive an initial email summarising the details of your order, a second email confirming payment and, where applicable, a third email from PayPal.
The Products are made to order and offered for sale until the raw material stock is exhausted.
4.2. Le Fil de l’Âme reserves the right not to confirm an order for any reason, including a problem with the supply of Products or a problem with the order received. In any event, the Customer will be informed as soon as possible by Le Fil de l’Âme, which will offer a replacement or a refund.
Article 5: Prices – Invoice
Prices are quoted in euros, including VAT. The price guaranteed to the Customer is the price displayed on the Website when the Product is placed in the basket. This price is firm, final and non-negotiable. Prices include VAT applicable on the date of the order. They are therefore quoted inclusive of VAT.
The order basket shows the delivery costs.
Any change in the applicable VAT rate may be reflected in the sale price of the Products in the catalogue.
The ‘TOTAL’ shown at the end of the order summary includes delivery costs and VAT. Once the order has been processed, an invoice will be available for download from the Customer’s account by clicking on ‘MY ACCOUNT’, then ‘MY ORDER HISTORY AND DETAILS’, then on the box corresponding to the order line and the ‘Invoice’ column. If there is no link or if you have difficulty downloading the invoice, one will be sent by email upon request to bonjour@lefildelame-paris.com.
Article 6: Payment
The accepted payment methods are indicated on the website at the beginning of the ordering process.
Payment of the full price is due upon ordering. No order can be finalised online without payment. The Customer undertakes to pay the total price stipulated on the order summary and to pay or arrange for payment, where applicable, directly to the freight forwarder or carrier, of any customs duties, VAT or other taxes due on the importation of the Products into the country of delivery. The Customer pays for their order by PayPal or credit card as offered on the Website.
Before proceeding with payment, the Customer indicates that they unreservedly accept these GTC as they exist on the day of their order and which they have read beforehand.
Payment for the order constitutes an irrevocable commitment on the part of the Customer, which can only be challenged in the cases exhaustively provided for in these GTC in the articles ‘Right of withdrawal’ and ‘Guarantees’.
Article 7: Payment security
For the security of your payments, Le Fil de l’Âme uses ‘PayPal’, an independent credit card payment solution. With this system, payment by card or via a PayPal account is made directly on PayPal’s secure server on behalf of Le Fil de l’Âme. The Customer must also read and accept PayPal’s terms and conditions.
For payment by CB, VISA or MASTERCARD credit card:
Through our partner STRIPE, Le Fil de l’Âme adheres to the secure remote payment system for ‘CB’ or ‘CB’-approved cards.
Article 8: Delivery
8.1. Products are delivered to the address indicated by the Customer on the form entitled ‘address’ (Step 3). When paying by PayPal, the Customer must check that the address used for their PayPal account is the same as the desired delivery address.
8.2. The order will be fulfilled within an average of 15 working days following the date of payment, subject to the availability of the Product ordered and unless otherwise agreed between the two parties. Delivery times are given for information purposes only and Le Fil de l’Âme cannot be held liable for them. However, the Customer expressly acknowledges that the delivery time may be extended by 20 days for deliveries outside mainland France. In the event of a stock shortage or unavailability of the Product ordered, Le Fil de l’Âme undertakes to inform the Customer as soon as possible and to specify a delivery time. The Customer shall confirm by e-mail whether they wish to wait for the Product to become available or receive a refund, to the exclusion of any damages.
A delay in delivery shall not give rise to any withholding, penalty, compensation or damages.
8.3. If, 60 (sixty) days after the order, the Product has not been delivered for any reason other than force majeure, the sale may then be cancelled at the request of either party by registered letter with acknowledgement of receipt, excluding any damages. The following are considered cases of force majeure releasing Le Fil de l’Âme from its obligation to deliver: war, riot, fire, strikes, accidents, regulations or requirements of public authorities, or any other event that is unavoidable, unforeseeable and beyond the control of Le Fil de l’Âme. Le Fil de l’Âme shall keep the Customer informed, in a timely manner, of the cases and events listed above. Le Fil de l’Âme shall reimburse the Customer for all sums paid, no later than 14 (fourteen) days after the date on which the contract was terminated.
8.4. In any event, delivery within the agreed time frame can only take place if the Customer is up to date with their obligations to Le Fil de l’Âme.
Upon delivery, the Customer must check the contents, conformity and condition of the Product(s). In the event of a problem, the Customer must follow the complaint procedure referred to in Articles 9 and 10 below.
Article 9: Warranties
9.1. Le Fil de l’Âme gives no warranty for apparent defects, detectable after normal examination of the Product, which may affect the delivered Product and which have not been reported by the Customer under the conditions stipulated below.
The Customer remains liable for any depreciation of the Products resulting from handling of the Products other than that necessary for the use of the Products.
9.2. Legal guarantee of conformity:
The legal guarantee of conformity covers defects in the conformity of the Product and packaging in the following situations:
-Goods unsuitable for the purpose usually expected of similar goods,
-Goods that do not correspond to the description given by the seller,
-Goods that do not possess the qualities advertised by the seller or agreed with the Customer.
To benefit from the legal guarantee of conformity, the defect in the Product must exist on the day of purchase. The Customer is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the Product. If the defect appears more than 24 months after purchase, the Customer cannot benefit from the guarantee of conformity unless they can prove that the defect existed on the day of purchase.
In the event of a lack of conformity, the Customer may choose between repair and replacement of the Product.
However, Le Fil de l’Âme may not proceed according to the Customer’s choice if this choice entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In this case, Le Fil de l’Âme is required to proceed according to the other option, unless this is impossible.
If repair and replacement of the Product are impossible, the Customer may return the Product and receive a refund, or keep the Product and receive a partial refund. However, the sale cannot be cancelled if the lack of conformity is minor.
The Customer has a period of 2 (two) years to return the Le Fil de l’Âme product, enclosing with the shipment (i) a letter explaining the problem and indicating the date on which the non-conformity was discovered, (ii) the delivery note and (iii) the invoice.
9.3. In accordance with Article 1641 of the Civil Code, Le Fil de l’Âme is also bound by the legal warranty against hidden defects.
To invoke the warranty against hidden defects, the defect in the Product must meet the following 3 conditions:
-Be hidden, i.e. not apparent at the time of purchase,
-Render the item unfit for its intended use, or significantly reduce its use,
-Exist at the time of purchase.
It is the Customer’s responsibility to prove the existence of a hidden defect.
The Customer has a period of two (2) years to return the Product to Le Fil de l’Âme, enclosing with the shipment (i) a letter explaining the problem and indicating the date on which the hidden defect was discovered, (ii) proof of the existence of the hidden defect, (iii) the delivery note, and (iv) the invoice.
If Le Fil de l’Âme considers that one of these two guarantees should be implemented, it will refund the price of the Product appearing on the purchase invoice, within a period allowing it to carry out a prior assessment of the Product.
Article 10: Right of withdrawal
The Customer has a period of 14 (fourteen) calendar days from receipt of their order to notify Le Fil de l’Âme that they wish to exercise their right of withdrawal. The Customer is informed that the return of the Product(s) will be at their expense, for exchange or refund, in accordance with Article L 212-21-3 of the Consumer Code. If this period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.
In the event of the purchase of several Products in a single order and delivered separately, the withdrawal period begins on the day the Customer takes physical possession of the last Product.
Notification of the exercise of the right of return may be made: by e-mail to bonjour@lefildelame-paris.com or by registered letter with acknowledgement of receipt. The Customer may use the following text:

Le Fil de l’Âme will acknowledge receipt of the Customer’s request.
After notifying Le Fil de l’Âme of their wish to exercise their right of withdrawal, the Customer has 14 (fourteen) days to return the Product in its original condition and packaging to the address of Le Fil de l’Âme.
It must not have been used, must not have suffered any damage, however slight, and must be in a perfectly clean condition. This right of withdrawal is exercised without penalty, except for the return costs, which remain the responsibility of the Customer. Within a maximum period of 14 (fourteen) days from receipt of the Product at Le Fil de l’Âme’s address, the Customer will be refunded the sums paid.
Article 11: Personal information
11.1. The personal information requested from the Customer is essential for processing and delivering orders and issuing invoices. For these purposes, this information may be communicated to Le Fil de l’Âme’s contractual partners, such as the payment provider or delivery service.
Bank details are not stored by Le Fil de l’Âme.
The Customer has the right to access, modify, rectify and delete data concerning them by sending an email to: bonjour@lefildelame-paris.com
Customers’ personal data is stored for an indefinite period.
11.2. Cookies
Le Fil de l’Âme uses the following types of cookies:
-Session cookies: data stored to ensure the proper functioning of the service and facilitate navigation;
-Audience measurement cookies: cookies used to collect statistics in aggregate form in analysis tools such as Google Analytics;
When browsing our Website, a message appears allowing the Customer to accept or refuse cookies.
The Customer can disable cookies by choosing:
-In the Internet Explorer browser menu, select ‘Tools’ and then click on the ‘Browse in private’ function;
-In the Mozilla Firefox menu: select ‘Options’, then ‘Privacy’: in the “History” area, for the ‘Retention rules’ option, select ‘use custom settings for history’ and uncheck the ‘Accept cookies’ box.
Otherwise, by continuing to visit the Le Fil de l’Âme website, the Customer agrees to cookies being installed during their browsing.
Cookies and associated data will be stored for a maximum period of 13 months.
Article 12: Formation of the contract
Clicking on ‘pay by credit card or PayPal’ constitutes an electronic signature validating the formation of the sales contract. This electronic signature between the parties has the same value as a handwritten signature. Clicking on the box indicating acceptance of the general terms and conditions of sale implies unreserved acceptance of these GTC.
As these terms and conditions are only available in French, you declare that you understand French and all the provisions of these GTC.
It is recommended that you print a copy and keep it for your records.
Article 13: Proof
The computerised records stored in Le Fil de l’Âme’s computer systems under reasonable security conditions shall be considered as proof of communication, orders and payments between the parties.
Orders and invoices are archived on a reliable and durable medium that can be produced as evidence.
Article 14: Intellectual property
Le Fil de l’Âme is the owner of the intellectual property rights to the Website and the right to distribute the elements appearing in the Website’s catalogue – in particular the photographs, for which Le Fil de l’Âme has obtained the necessary authorisations from the persons concerned, or of which Le Fil de l’Âme is the author. Consequently, any total or partial reproduction of the Website is strictly prohibited, as is any reproduction of the elements contained on the Website.
Any reproduction or use of the elements of the Website would constitute a violation of intellectual and industrial property regulations.
The Products themselves, as original creations, are also protected by national and international copyright provisions.
Le Fil de l’Âme reserves the right to take legal action against any person who infringes its rights and these general terms and conditions.
Article 15: Warning
Le Fil de l’Âme undertakes to ensure the functioning of the Website in order to allow optimal use under the conditions defined in these general terms and conditions. The user declares that they are aware of the unreliability of the Internet, in particular:
-Regarding the security of data transmission;
-Regarding the obligation to protect their computer equipment or network with regularly updated anti-virus software;
-Regarding the unguaranteed performance in terms of data transmission volume and speed;
-Regarding the fact that continuous access to the service is not guaranteed.
The service may be suspended occasionally due to maintenance work necessary for the proper functioning of the Website.
Le Fil de l’Âme cannot be held liable in the event of malfunction of the Website due to maintenance, technical problems, inability to access the Website, or hosting server failures.
Article 16: Links
The Site contains hypertext links to partners. In the event that the user consults partner sites, Le Fil de l’Âme declines all responsibility for access to, content and use of the sites, and any damage that may result therefrom.
Article 17: Entire agreement
These general terms and conditions of sale express the entirety of the obligations of the parties. No other general or specific terms and conditions communicated by the customer may be incorporated into or derogate from these general terms and conditions.
Article 18: Disputes
In accordance with Article L.133-4 of the French Consumer Code, the Customer is informed of the possibility of resorting, free of charge, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method.
